Supreme Court Finds No Separate Cause of Action Against An Insurer For Breach of Duty of Good Faith And Fair Dealing

The Florida Supreme Court, in QBE Ins. Corp. v. Chalfonte Condominium Apartment Assoc., 37 Fla. L. Weekly S395 (Fla., May 31,2012) issued a long-awaited decision addressing several issues, the most important of which is whether Florida law recognizes a claim for breach of implied warranty of good faith and fair dealing by an insured against its insurer based on the insurer’s alleged failure to investigate the insured’s claim within a reasonable period of time.
