Zak D. Martinez is a member of the firm’s first-party property practice defending insurance carriers in homeowner’s insurance litigation. He joined Conroy Simberg after practicing Family Law across Texas and Florida, and first-party property litigation in the South Florida region. After earning a Bachelor of Arts degree in Economics and Religious Studies from the Dedman College of Humanities and Sciences at Southern Methodist University in 2013, Mr. Martinez earned a Juris Doctor from the Texas A&M School of Law in Fort Worth, Texas in 2017.

Representative Experience:

  • 2024 – Zak prevailed on a motion for judgment on the pleadings in a non-catastrophic homeowners claim in Hernando County where he argued the Assignment of Benefits contract entered into by the Plaintiff and named insured was invalid per the Florida Statutes, and thus, Plaintiff lacked standing to bring the suit. 

  • 2023- Zak prevailed on a motion for summary judgment on a non-catastrophic homeowners claim in Hernando County where he argued the Plaintiffs were not entitled to recover for water damage to the interior of the property caused by rainwater entering through the roof via a vent ridge as the same did not constitute a peril-created opening pursuant to the terms and conditions of the policy of insurance.
