Amy Klotz, an attorney in the firm’s appellate litigation support division, prevailed on an AOB summary judgment. In this case, the court granted summary judgment in favor of our client, finding that the plaintiff lacked standing to bring the suit because the AOBs on which the plaintiff relied pertained to services to be performed under urgent or emergency circumstances in excess of $3,000.00, which is expressly prohibited by Fla. Stat. § 627.7152(2)(c).

In this case, the court granted summary judgment in favor of our client, finding that the plaintiff lacked standing to bring the suit, and dismissed the plaintiff’s complaint with prejudice pursuant to Fla. Stat. § 627.7152(2)(d). 

Joshua C. Canton, managing partner of the firm's Tallahassee, Florida office, along with Justin B. Hales, an associate in the firm’s Tallahassee, Florida office, recently prevailed on a motion to dismiss with prejudice wherein Plaintiff filed a suit in 2017 and sought to add their client as a Defendant in 2023.  Mr. Canton and Mr. Hales successfully argued the statute of limitations had expired and the naming of the client as a Defendant did not relate back to the original filing of the Complaint in 2017.

Rod C. Lundy, a partner, and Luc H. Adeclat, an associate, both of our Orlando office, recently prevailed on a motion for final summary judgment. In this matter, Plaintiff alleged our funeral home client negligently arranged and conducted a funeral procession such that a co-defendant driver in the procession went through a red light and hit Plaintiff’s vehicle. Specifically,  Plaintiff alleged the accident occurred because the funeral home failed to fully instruct those in the procession of the traffic rules outlined in Fla. Stat. 316.1974. 

Miles A. McGrane, IV a partner in our Hollywood Office, was recently sworn in as an Executive Board Member and Secretary of the Fort Lauderdale Chapter of The American Board of Trial Advocates (“ABOTA”). ABOTA is a national association of experienced trial lawyers and judges that are dedicated to the preservation and promotion of the right to a civil jury trial-a right provided by the Seventh Amendment to the U.S. Constitution. ABOTA membership is by invitation only and is comprised of Defense lawyers, Plaintiff’s lawyers and judges who focus on civil trial practice. Since its founding in 1958 ABOTA has worked tirelessly to uphold the jury system and to elevate the standards of professionalism, integrity and civility in the legal profession.
