<title>Summary Judgment Granted in Condominium Premises Liability Matter</title>

<description><![CDATA[<p>Hollywood Partner, <strong><a href="https://www.conroysimberg.com/attorneys/lauren-mcendree/" target="_blank">Lauren McEndree</a></strong> successfully obtained summary judgment on behalf of a condominium association and property management company in a Miami-Dade County premises liability case. The plaintiff alleged she sustained injuries after becoming trapped in a trash chute room and eventually jumping down the building's trash chute. The court ruled that, even assuming a factual dispute existed regarding the condition of the door, the plaintiff's voluntary decision to jump down the trash chute established a cause that broke the chain of legal causation. The Court found that the plaintiff could not establish that the defendants' alleged negligence caused her claimed injuries. </p>]]></description>

The plaintiff alleged injuries arising from a slip-and-fall incident. The defense focused its arguments on the legal standards governing the mode of operation doctrine and the plaintiff's inability to establish actual or constructive notice of the alleged dangerous condition. The court agreed and granted Final Summary Judgment.</p>]]></description>

The Court determined there was no dispute of a material fact in the case and found for the Defendant.</p>]]></description>

<title>Orlando Attorneys Secure Summary Judgment for LLC Manager</title>

<description><![CDATA[<p><strong><a href="https://www.conroysimberg.com/attorneys/rodney-c-lundy/" target="_blank">Rod Lundy</a></strong> and <strong><a href="https://www.conroysimberg.com/attorneys/luc-h-adeclat/" target="_blank">Luc Adeclat</a></strong>, attorneys in our Orlando office, prevailed on a summary judgment in Brevard County on behalf of an LLC’s manager who was sued along with the LLC in a negligence and premises action alleging plaintiff was injured by an LLC employee.  The court agreed sections 605.0304 and 605.04093, Florida Statutes, provided the individual manager tort immunity as the conduct alleged did not fall within the limited exceptions. As such, the court granted the defense motion and entered judgment for the LLC manager.  A motion for fees and costs per section 57.105, Florida Statutes, and an unaccepted proposal for settlement is pending. </p>]]></description>

Based on records from medical providers, which the plaintiff failed to disclose, Chandler and Amy showed that the plaintiff provided false interrogatory responses and deposition testimony regarding her alleged injuries. The plaintiff argued that she inadvertently failed to disclose prior complaints of pain in an area of her body she claimed sustained injury in the accident due to her age (70). She also took positions inconsistent with  information contained in the medical records. Chandler and Amy pointed out that, in her deposition, the plaintiff provided detailed information regarding medical treatment unrelated to her claim but failed to disclose any pertinent medical treatment. </p>]]></description>

<description><![CDATA[<p>Partner <strong><a href="https://www.conroysimberg.com/attorneys/michael-s-kast/" target="_blank">Michael Kast</a></strong>, and associate, <strong><a href="https://www.conroysimberg.com/attorneys/aaron-b-zeilberger/" target="_blank">Aaron Zeilberger</a></strong>, of our firm’s Orlando office, secured a favorable defense result in a premises liability case involving a slip and fall at a grocery store, where there were no posted signs. Although the plaintiff alleged that a wet floor aggravated several prior injuries and required multiple surgeries, the defense vigorously contested causation and the extent of the new injuries. While the plaintiff’s counsel requested over $883,000 during closing arguments, the jury returned a gross verdict of only $250,000. After accounting for a 10% comparative negligence finding, the net verdict was reduced to $225,000. This outcome represented a significant victory, as the final award was nearly $200,000 less than the plaintiff's lowest mid-trial demand.</p>]]></description>

Zeilberger</a></strong>, an associate based in the Orlando office, successfully represented a family-owned supermarket in securing a motion to dismiss a slip-and-fall case on the basis of fraud. The Plaintiff alleged significant lower back injuries from a 2019 fall requiring surgery. During her deposition, she repeatedly claimed she "could not recall" any history of prior lower back pain or treatment beyond a single 2008 incident. However, the Defense submitted irrefutable medical records that proved the plaintiff had a long and extensive history of severe lower back treatment in the years leading up to the incident. The Court determined that dismissal was warranted because the Defense successfully demonstrated, by clear and convincing evidence, that the Plaintiff engaged in a pattern of fraudulent conduct during the discovery process.</p>]]></description>

<title>Jesse Groves Secures Summary Judgment Victory, Affirmed by the Second DCA</title>

<description><![CDATA[<p><strong><a href="https://www.conroysimberg.com/attorneys/jesse-c-groves/" target="_blank">Jesse Groves</a></strong> recently obtained a final summary judgment in a first-party property insurance case in Manatee County, which was affirmed by the Second District Court of Appeals.  Plaintiff filed her lawsuit against Defendant after the subject claim for water damage was denied based on the policy exclusion for Continuous or Repeated Seepage or Leakage over a period of time.  Defendant filed its Motion for Summary Judgment based on expert opinion that the damages were the result of a repetitive shower leak that occurred for at least six months.  Plaintiff filed an expert affidavit in opposition to the MSJ, which asserted that the damage was the result of a “sudden and accidental” leak.  </p>]]></description>
