Dismissal Obtained in First-Party Property Insurance Case

Elliott Tubbs recently obtained final dismissal in a first-party property insurance case in Sarasota County, Florida. Plaintiffs filed their lawsuit against Defendant several months past the applicable statute of limitations. Defendant filed a Motion To Dismiss With Prejudice. Plaintiffs opposed the motion claiming that a different statute of limitations deadline was applicable and that multiple estoppel issues existed. The Court granted the Defendant’s Motion To Dismiss With Prejudice because it agreed that the lawsuit was not timely filed. The Court rejected the Plaintiffs’ arguments that Defendant’s actions extended the deadline to file the lawsuit and that there was a different applicable deadline to file their lawsuit against Defendant.
