Hinda Klein, Elliott Tubbs and Megan Powell recently obtained final summary judgment in a first-party property insurance case in Palm Beach County, Florida. Plaintiff filed his lawsuit against Defendant over one year past the applicable statute of limitations.  Defendant filed a Motion For Summary Judgment.  Plaintiff opposed the motion and claimed multiple estoppel issues.  The Court granted the Defendant’s Motion For Summary Judgment because it agreed that the lawsuit was not timely filed.  The Court rejected the Plaintiff’s arguments that Defendant failed to comply with certain notice duties and that Defendant’s actions and inactions extended the deadline to file the lawsuit.
