Jacksonville Partner Secures Summary Judgment in a Slip and Fall Case

Sean C. Barber, a partner in the firm's Jacksonville office, recently secured a summary judgment in a slip-and-fall case on behalf of a janitorial services provider. The Court found that there was no evidence of actual or constructive notice on the part of the defendant regarding a transitory foreign substance. Evidence showed the defendant’s employee had properly placed warning signs and a red-light indicator, and even provided a verbal warning that the floor was wet before the plaintiff entered the area. Because the plaintiff failed to establish a dispute of material fact, the Court granted the motion, and the firm is now entitled to recover costs.
