Orlando Partners Secure Defense Verdict in Admitted Liability Auto Case

Rod Lundy and Tylar Heintz, partners in our Orlando office, obtained a defense verdict in a 6-day admitted liability auto case in Orange County, Florida.
When changing lanes from a near stop, defendant’s right front collided with plaintiff’s left rear quarter panel as plaintiff drove by in the right lane. Both vehicles were drivable with no scene injuries reported. The incident was captured on dash cam video in the vehicle behind plaintiff.
Plaintiff underwent numerous back and neck procedures, including a cervical fusion, with recommendations for a lumbar fusion and a second cervical fusion. Plaintiff boarded over 200k in past meds and 820k in future meds.
Causation was strongly contested with the parties disputing the level of impact forces and permanent aggravation of previous conditions. To that end, both parties presented biomechanical/MD experts, along with surgeons, radiologists, and life care planners. The jury found the admitted negligence of defendant was not the legal cause of injury, damage, or loss to plaintiff.
