Hollywood Partner, Lauren McEndree successfully obtained summary judgment on behalf of a condominium association and property management company in a Miami-Dade County premises liability case. The plaintiff alleged she sustained injuries after becoming trapped in a trash chute room and eventually jumping down the building's trash chute. The court ruled that, even assuming a factual dispute existed regarding the condition of the door, the plaintiff's voluntary decision to jump down the trash chute established a cause that broke the chain of legal causation. The Court found that the plaintiff could not establish that the defendants' alleged negligence caused her claimed injuries.
