Tampa partners Eric Faulkner and Nicole Soto obtained a defense verdict in a challenging case involving a minor who darted into traffic and was struck by a passing vehicle. 

Our team represented the owner of an industrial business park where the accident occurred. The plaintiff alleged that the property’s parking lot design was deficient and in violation of ADA standards—arguing that, had the design met those standards, the minor’s visibility would have been improved. The defense demonstrated that this was a tragic but unforeseeable event caused by a lack of supervision by the caregivers, not by any condition or design of the property. After careful deliberation, the jury agreed and returned a defense verdict
