Jacksonville Attorneys Secure Defense Verdict in Premises Liability Trial

Jacksonville partners John Viggiani, Esther K. Erkan, and Jeffrey A. Yarbrough recently secured a defense verdict in a two-week premises liability trial in Duval County, Florida. The case involved a plaintiff who fell within a construction zone in front of a major department store.
The Plaintiff claimed that she tripped over the leg of a barricade, alleging that a bright orange traffic cone was improperly placed and obscured the leg from view. As a result of the fall on her hands and face, the Plaintiff claimed to have suffered a Traumatic Brain Injury (TBI), headaches, memory loss, neck and back pain, and bilateral hip pain.
During the trial, the Plaintiff called eight treating physicians to testify regarding her injuries. With past medical expenses totaling $132,000, the Plaintiff sought $2.5 million in future medical costs.
The jury deliberated for just two hours before returning a defense verdict.
